Rules for processing personal data

Below, I provide information on the principles of processing of your personal data by Monika Macura Law Firm within the scope of the provided services under the name Kancelaria Radcy Prawnego Monika Macura (hereinafter: ‘Law firm’), as well as on the website www.kancelariamacura.pl (hereinafter: ‘Website’).
The information is provided on the basis of Article 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 94/46/EC (hereinafter: ‘GDPR’).

2. PURPOSES AND LEGAL BASIS OF PROCESSING PERSONAL DATA
Your personal data will be processed by the Administrator for the following purposes:
- for the proper performance of the contract for the provision of electronic services by the Administrator, on the basis of Article 6 section (1) letter (b) of the GDPR;
- for the proper performance of the contract with regard to the services provided by the Administrator, on the basis of Article 6 section (1) letter (b) of the GDPR;
- in order for the Administrator to properly comply with its obligations under generally applicable law, in particular concerning the rules of practice of the profession by attorneys at law, including their obligations towards clients, the professional self-government or public authorities, on the basis of Article 6 section (1) letter (c) GDPR;
- for the purpose of initiating or maintaining a business relationship, on the basis of Article 6 section (1) letter (f) of the GDPR;
- in order to provide the service of sending a newsletter containing marketing content to persons who are customers of the Administrator, on the basis of Article 6section (1) letter (b) of the GDPR;
- in order to provide the service of sending a newsletter containing marketing content to persons who are not customers of the Administrator and who have voluntarily agreed to receive it, on the basis of Article 6 section (1) letter (f) GDPR;
- for the purpose of direct marketing of the services provided by the Administrator to persons who are its customers, on the basis of Article 6 section (1) letter (f) of the GDPR;
- for the direct marketing of the services provided by the Administrator to non-customers, on the basis of Article 6 section (1) letter (a) of the GDPR;
- for the purpose of replying to a message received electronically or by post, on the basis of Article 6 section (1) letter (f) of the GDPR;
- in order to respond to the issue described when contacting the Administrator by telephone, on the basis of Article 6 section (1) letter (f) of the GDPR;
- in order to carry out the recruitment process, including for future recruitment processes, on the basis of Article 6 section (1) letter (a) of the GDPR;
- in order to analyse the use of the Site, improve its operation and security, on the basis of Article 6 section (1) letter (f) of the GDPR;
- for the purpose of dealing with complaints, defending against claims you may have in connection with the provision of services by the Administrator, including electronic services, or for the processing of your personal data, on the basis of Article 6 section (1) letter (f) GDPR.

The controller obtains your personal data directly from you.
In addition, personal data is automatically collected in connection with your use of the Website.

Provision of legal services
The Administrator, in order to provide legal services with the utmost care, shall process your identification data, such as name, residential address, PESEL, as well as contact data in the form of telephone number and e-mail address. In addition, the Administrator processes the data contained in the documentation received from you. The above data may also include your employees and associates who contact the Administrator or its employees or associates directly on your behalf.
Contacting the Administrator
The Administrator collects the data provided by you in the content of the message addressed to the Administrator. Depending on the path of contact chosen by you, your contact details will also be collected, as well as, in the case of contact by post, your identification data.
Newsletter
The Administrator processes your e-mail address.
Recruitment
The Administrator processes the data contained in the Curriculum Vitae (CV) and optionally in the motivation letter that Administrator receives from you, including your identification data, contact details and professional qualifications.
- Data collected automatically, not coming directly from the user
In order to ensure the security of the functioning of the Site, as well as your safety as a user, the Administrator processes certain personal data automatically. This data includes, but is not limited to, IP addresses, location, parameters of the hardware and software used by you, device identification numbers. - Data contained in cookies

The Administrator does not obtain your sensitive data within the meaning of Article 9 GDPR.
5. RECIPIENTS OF THE DATA
Your personal data may be disclosed to entities providing services to the Administrator, including but not limited to: analytical services, IT services, accounting and bookkeeping services, marketing services. Employees and associates of the Administrator may also have access to the processed data.
6. TRANSFER OF DATA TO A THIRD COUNTRY OR INTERNATIONAL ORGANISATION
Your personal data will not be transferred to a third country or international organisation.
7. AUTOMATED DECISION-MAKING INCLUDING PROFILING
Your data will not be processed by automated means, including profiling.
8. RETENTION PERIOD OF PERSONAL DATA
Your personal data will be processed:
- for the proper performance of the contract for the provision of services by electronic means – for the duration of the contract for the provision of services by electronic means;
- for the proper performance of the contract – for the duration of the contract;
- for the purposes of proper fulfilment of the Administrator’s obligations under generally applicable law – for the period necessary to demonstrate that the Administrator has properly discharged those obligations;
- for the purposes of initiating or maintaining business contacts – for the duration of the business relationship;
- for the purpose of providing the service of sending a newsletter containing marketing content to persons who are customers of the Administrator – personal data is processed for the duration of the contract or until you raise an objection;
- for the purpose of providing the service of sending a newsletter containing marketing content to persons who are not customers of the Administrator and who have voluntarily agreed to receive it – personal data is processed until the consent to receive the newsletter is withdrawn;
- for direct marketing purposes in relation to persons who are customers – personal data is processed until the contract is terminated or you raise an objection;
- for direct marketing purposes to non-customers – personal data is processed until you withdraw your consent;
- for the purpose of replying to a message received electronically or by post – personal data is processed until the correspondence with you has been completed;
- for the purposes of responding to a problem described when contacting the Administrator by telephone – personal data is processed until the telephone call is completed;
- for the purposes of conducting the recruitment process, including for future recruitment processes – personal data is processed until you withdraw your consent;
- for the purpose of analysing the use of the Website, improving its operation and security, for a period of 3 years from receipt of the data;
- for the purpose of dealing with your complaints, defending against claims that you may have in connection with the provision of services by the Administrator, including electronic services, or in respect of the processing of your personal data – until your potential claims against the Administrator are time-barred.
9. RIGHTS IN RELATION TO DATA PROCESSING
You have the right of access to your data and the right to request their rectification if they are inaccurate, their erasure or the restriction of their processing.
To the extent that the processing of your personal data is based on the premise of a legitimate interest of the Controller, you have the right to object to the processing of your personal data.
To the extent that the processing of your personal data is based on consent, you have the right to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal.
If you have given your consent to the sending of commercial information by e-mail, you have the right to withdraw your consent, for example by sending an e-mail to: kancelaria@kancelariamacura.pl.
To the extent that the basis for the processing of your personal data is Article 6 section (1)letter (a) or Article 6 section (1) letter (b) of the GDPR and the processing is carried out by automated means, you also have the right to receive your personal data from the Controller, in a structured, commonly used machine-readable format, you may also send this data to another controller.
10. THE RIGHT TO LODGE A COMPLAINT WITH A SUPERVISORY AUTHORITY
You also have the right to lodge a complaint with the supervisory authority in charge of personal data protection, which is the President of the Office for Personal Data Protection.
11. INFORMATION THAT PERSONAL DATA IS VOLUNTARY OR OBLIGATORY
The provision of data is voluntary.
