Legal documentation for BNPL (buy-now-pay-later)
For one of our clients we developed the legal documentation for the bnpl deferred payment product.
The basic buy now pay later (“BNPL”) model is a credit solution that facilitates online purchases. The consumer, when making a purchase, uses the deferred payment option, in case of non-payment within a free period of e.g. 30 days, the repayment is split into instalments and the service is “transformed” into a consumer credit.
Working with the client, we actively participated in determining the structure of the product, advised in terms of legal requirements, but also legal and economic conditions. We supported the client in deciding on the nature of the product, ensuring regulatory compliance while meeting the client’s business objectives.
In performing the service, we also audited procedures, client communications, advertising and marketing materials and prepared the necessary documentation including regulations and contracts. We are currently conducting legal oversight of the product implementation.
