Development and implementation of an online payment application

Legal assistance for the creation and implementation of an online payment application.

Online payments in the current situation of e-commerce are an essential tool for increasing turnover in any online shop. The convenience of customers in choosing both the method of payment and its form, including applying for a loan or deferring payment, directly translates into an increase in conversion, or an increase in the value of the customer’s basket and a reduction in the number of transactions abandoned at the stage before the purchase is finalised.

We advised the company, which has the status of a Small Payment Institution (SPI) and specialises in the intermediation of the best financial products and services, listed on the WSE, on negotiating the terms and conditions for the creation of a tool tailored to the current legal regulations and business needs, allowing online shop customers to use deferred payments (Buy Now, Pay Later, BNPL) and a wide range of consumer loans provided by both banking and non-banking institutions.

As part of the project, we also negotiated the implementation of the resulting online payment tool (application) on major sales platforms and created and reviewed the necessary documentation.

In addition, we also supported our client during the creation of agreements and necessary documentation for the integration of the online payment tool in individual shops, with particular emphasis on the ease of communication and conclusion of agreements by individual entrepreneurs with the Company. We also created the regulations necessary due to the requirements of the Electronic Services Act or the Consumer Rights Act. We also advised during the creation of processes necessary to conduct business in accordance with the Act on the Processing of Complaints by Financial Market Entities and the Financial Ombudsman and the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation).
